Terms of Service
TBD
This document is a draft and has not been finalized.
These Terms of Service (the “Terms”) set out the conditions for using the services related to the iOS app “DORILOG” and the dedicated unit “doripod” provided by CODIANZ Inc. (“we”, “us”) (together, the “Service”). Everyone who uses the Service (“users”) agrees to these Terms before using the Service.
Article 1 (Application)
These Terms apply to all relationships between users and us concerning the use of the Service. Individual rules and guidelines that we post on the Service form part of these Terms.
Article 2 (The Service)
The Service records and displays driving lines, drift angles, speed and other data based on data obtained from GPS and other external devices. We may change, add to or discontinue the Service without prior notice to users.
Article 3 (Safe use)
- The Service is intended for use at circuits, track days and other venues where driving is permitted. Do not use the Service for drifting on public roads or any other driving that violates the law.
- Do not look at or operate the device screen while driving. Install and operate equipment only while safely stopped.
- Mount equipment securely where it does not interfere with driving or your view.
- Users are responsible for any accidents, damage or violations arising from driving.
Article 4 (Nature of measured data)
Values shown in the Service (position, speed, angle, etc.) may contain errors depending on the positioning environment and the condition of the equipment. We do not guarantee the accuracy, completeness or fitness for a particular purpose of measured data. If you use it for official competition judging or similar purposes, you do so at your own judgment and responsibility.
Article 5 (Prohibited conduct)
Users must not do any of the following when using the Service.
- Acts that violate laws or public order and morals
- Modifying, reverse engineering, decompiling or disassembling the Service’s software (except as permitted by law)
- Interfering with the operation of the Service or placing an excessive load on our servers or networks
- Infringing the intellectual property, portrait, privacy or other rights of us or third parties
- Any other conduct we deem inappropriate
Article 6 (Intellectual property)
All intellectual property rights in the software, design, logos, trademarks and other materials of the Service belong to us or the rightful owners. Rights in the driving data that users record with the Service belong to the users.
Article 7 (Paid services)
If we provide part of the Service for a fee, fees and payment methods follow the terms of the App Store or other provider. Except as required by law, fees paid are non-refundable.
Article 8 (Suspension of the Service)
We may suspend or interrupt all or part of the Service without prior notice to users in the event of system maintenance, failures, natural disasters or other unavoidable circumstances.
Article 9 (Disclaimer)
- We do not guarantee that the Service is free of defects in fact or law (including safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security flaws, errors and bugs).
- We are not liable for any damage to users arising from the use of or inability to use the Service, except in cases of our willful misconduct or gross negligence.
- Even where we are liable under the Consumer Contract Act or other laws, our liability is limited to ordinary and direct damage actually incurred by the user, except in cases of our willful misconduct or gross negligence.
Article 10 (Changes to these Terms)
We may change these Terms when we consider it necessary. The revised Terms take effect when posted on this site or in the Service.
Article 11 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan. Any dispute relating to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
